1. The Service
These Terms of Service ("Terms") govern access to and use of Barvinca, including the Barvinca website, hosted web app, token-based access, support services, and related Autodesk Platform Services workflows (collectively, the "Service"). The Service is provided by ФОП Ємельянов Дмитро Сергійович.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. Barvinca is not an Autodesk product. Autodesk services are governed by Autodesk's own terms and policies.
2. Token-Based Access
The initial Autodesk Marketplace listing may include a one-time welcome balance of 50 BRV. One Autodesk write mutation costs 1 BRV. Reads, setup checks, sync, discovery, previews, and dry-runs cost 0 BRV.
- Welcome access is limited, revocable, and provided for evaluation.
- Welcome BRV does not expire by time limit, but may be exhausted by approved write execution.
- Barvinca may limit features, operation volume, export volume, support level, or service availability.
- No paid subscription is created by receiving the welcome BRV balance.
- No PayPal, card, or paid checkout is collected by Barvinca for the welcome balance.
If paid plans are introduced later, Barvinca will publish updated payment and cancellation terms before paid checkout is enabled.
3. Accounts And Security
You are responsible for maintaining the confidentiality of your accounts, sessions, credentials, tokens, and authorized users. You must promptly notify us if you believe your account or credentials have been compromised.
4. Autodesk Access And Customer Responsibilities
You are responsible for having the Autodesk licenses, permissions, and account rights needed for the workflows you run; complying with Autodesk terms and policies; reviewing dry-run previews and operation details before approving changes; ensuring that bulk changes are lawful and authorized; and maintaining backups and internal controls suitable for your organization.
Barvinca performs customer-directed workflows. You remain responsible for the Autodesk data, projects, accounts, users, roles, permissions, and files you choose to access or modify.
5. Customer Data And Credentials
You retain ownership of your data. You grant Barvinca the limited rights needed to host, process, transmit, store, and display data as necessary to provide the Service, secure the Service, provide support, and comply with legal obligations.
If you provide APS Client IDs, APS Client Secrets, OAuth authorization, or other credentials, you authorize Barvinca to use them only to provide the Service and perform workflows you request.
6. Acceptable Use
- Do not use the Service for unlawful, harmful, or unauthorized purposes.
- Do not access Autodesk data or systems without permission.
- Do not bypass authentication, authorization, rate limits, or usage limits.
- Do not probe, scan, or test the Service except through an approved security disclosure process.
- Do not upload malware or malicious content.
- Do not interfere with service reliability.
- Do not remove, obscure, or misrepresent audit logs, warnings, dry-run results, or operation status.
7. Support
Support is provided according to the Barvinca Support Policy at barvinca.com/support. Welcome-access users receive best-effort support unless a separate written agreement says otherwise.
8. Intellectual Property
Barvinca and its software, workflows, interface, documentation, trademarks, logos, and service components are owned by Barvinca or its licensors. These Terms do not transfer ownership of Barvinca intellectual property.
9. Third-Party Services
The Service depends on third-party services, including Autodesk services and cloud infrastructure providers. Barvinca is not responsible for third-party service outages, changes, data, terms, or conduct.
10. Suspension And Termination
We may suspend or terminate access if you violate these Terms, your use creates a security or legal risk, your BRV balance is exhausted, Autodesk authorization is revoked or fails, or we discontinue welcome access or the Service.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Barvinca disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
Barvinca does not provide architectural, engineering, construction, legal, accounting, or compliance advice.
12. Limitation Of Liability
To the maximum extent permitted by law, Barvinca will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill. Barvinca's aggregate liability for all claims related to welcome access will not exceed USD 100.
13. Indemnity
You will defend, indemnify, and hold harmless Barvinca from claims, damages, liabilities, costs, and expenses arising from your use of the Service, your Autodesk data or credentials, your violation of these Terms, or your violation of applicable law or third-party rights.
14. Governing Law
These Terms are governed by the laws of Ukraine. Courts of Ukraine will have jurisdiction unless applicable mandatory law requires otherwise.
